If, between August 20, 2020 and August 20, 2024, you received text messages from Athena Bitcoin, Inc. after sending a “stop” request, a class action lawsuit may affect your rights ("IDNC Class").

- A lawsuit has been filed against Athena Bitcoin, Inc. (“Athena”), claiming it sent telemarketing text messages to people who requested that those messages stop.
- You are a potential class member if you are a residential telephone subscriber and, between August 20, 2020 and August 20, 2024, sent the message “stop” to Athena but received at least two text messages from Athena more than 30 days after.
- The court has not yet decided whether Athena did anything wrong. There is no money available now and no guarantee that there will be. Your legal rights are affected, however, and you now have a choice to make, as described below.

- Your options are explained in the Notice. To be excluded, you must act before December 8, 2025. To remain a part of this lawsuit, you do not need to do anything.
- If you do nothing, and if this lawsuit is not resolved before trial, Plaintiffs’ lawyers must prove the legal claims against Athena at trial. If money or benefits are obtained from Athena, you will then be notified about how to potentially receive a share.
